The Facts: Found asleep at the wheel in the early hours of the morning, engine running, car in ‘park’ position; the only person in the car; breath analysis 0-193.
The Result: Section 10 dismissal. This is a rare result and does not mean that you would receive the same result even in similar circumstances. In this case, the client had been driven to that location due to intoxication. The driver left the car and the client got into the driver’s seat – but did not drive. There was some discussion about whether the client attempted to put the vehicle into motion. Given that the vehicle had not travelled any distance; that the client had a great driving record and no criminal record; that no person was actually put at risk; the Court saw fit to not record a conviction.
Only a specialist criminal lawyer would normally be able to obtain this result because it takes a certain level of experience, confidence, skill and presentation to nail such a perfect result.
