The Guideline Judgment for High Range Drink Driving is every unforgiving and expressly states that the reason for drinking is not a mitigating factor. However, when a client has a mental illness or a mental condition, the court can sometimes be persuaded to deal with a person outside of the criminal justice system. Here, the client faced an automatic period of 3 years off the road, a fine of up to $3,300 and potentially imprisonment. Extremely high readings can indicate a high level or moral culpability. In this case, a client with psychological problems was unsuccessful on a mental health application but was dealt with compassionately by being given the benefit of Section 10 – no conviction recorded. It was a most deserving case – but such results are rare.
